General Terms and Conditions of Sale

ARTICLE 1 – OBJECT

The present General Terms and Conditions of Sale apply to all sales concluded on the website.

Article 2: Intellectual Property

All elements on the site, including texts, graphics, logos, sounds, photos, and animations, are the exclusive property of the Seller, except for trademarks, logos, or content belonging to other partner companies or authors.

The reproduction, distribution, modification, adaptation, retransmission, or publication, even partially, of these various elements is strictly prohibited without the express written consent of the Seller.

Any such representation or reproduction, by any means whatsoever, constitutes an infringement punishable under Articles L.335-2 and following of the Intellectual Property Code.

Article 2.1: Conditions of Use of the Site

The use of the site is reserved for strictly personal use.

Any use for commercial or advertising purposes is prohibited without the express permission of the Seller.

The site must be used in accordance with the legal and regulatory provisions in force.

Any fraudulent use of the site or any use that would contravene these GTC may result in the refusal of access to the service, without prejudice to any damages that the Seller may claim.

Article 2.2: Modification of the Conditions

The Seller reserves the right to modify the terms of use of its site at any time.

It is therefore recommended that users regularly consult the latest version of the GTC available on the site.

Article 2.3: Duration

These conditions apply for as long as the services offered by the Seller are available on the site.

ARTICLE 3 – DEFINITIONS

The terms used below shall, in these General Terms and Conditions of Sale, have the following meanings:

  • “Customer”: refers to the contracting party of the Seller, who warrants having the status of consumer as defined by French law and case law. As such, it is expressly provided that this Customer is acting solely for their own account and not as part of any regular or commercial activity.
  • “Delivery”: refers to the initial presentation of the Products ordered by the Customer at the delivery address provided when placing the order.
  • “Products”: refers to all products available on the website.
  • “Website”: refers to the website operated by the Seller identified in Article 2.
  • “Territory”: refers to United Kingdom (excluding Overseas Departments/Territories).

ARTICLE 4 – SCOPE

These General Terms and Conditions of Sale are reserved for consumers only, in the sense defined by law and case law, acting exclusively on their own behalf and domiciled in United Kingdom.

ARTICLE 5 – COMMENCEMENT AND DURATION

These General Terms and Conditions of Sale come into effect on the date of order confirmation.

ARTICLE 6 – ACCEPTANCE

The Customer’s acceptance of these General Terms and Conditions of Sale is indicated by their electronic signature, as evidenced by clicking the validation button.

This action signifies that the Customer has fully read and accepted these General Terms and Conditions of Sale.

ARTICLE 7 – PRODUCTS

The products offered for sale are those that appear on the website on the day the Customer consults the site.

They are offered for sale until stocks are exhausted.

ARTICLE 8 – PRICES

The prices are indicated on the website in euros, all taxes included (TTC), and delivery is free.

ARTICLE 9 – ORDERING

Placing an order on the website is subject to the procedure established by the Seller.

ARTICLE 10 – PAYMENT

Payment for purchases is made by bank card (credit or debit) such as Visa, Mastercard, American Express, Discover, JCB, and Diners Club International, as well as Google Pay, Apple Pay, and PayPal.

You must be authorised to use the selected payment method.

ARTICLE 11 – DELIVERY

Delivery is carried out by the carrier La Poste, to the address provided by the Customer when placing the order.

The Seller undertakes to use its best efforts to deliver the products ordered by the Customer within the specified timeframes.

ARTICLE 12 – RIGHT OF WITHDRAWAL

Restocking fee: £0

Shipping fees: At the customer’s expense

Return period: 14 days

Exchanges: Accepted

In accordance with Article L.121-21 of the French Consumer Code, the Customer has a 14-day withdrawal period from the receipt of the products to exercise their right of withdrawal without having to provide any justification or incur any penalty.

However, the return shipping costs are the responsibility of the Customer.

Below is the returns procedure:

Exchanges and returns may be made within 14 days of receiving your order.

If you wish to exercise this right, please contact us providing as much detail as possible regarding your situation and your request.

Below is the process:

A. You wish to return or exchange an item that does not suit you.

      • Ensure you are within the 14-day period.
      • The item must be in its original packaging.
      • The item must not have been worn or used.

    If everything is in order, please take photos of the product and contact us via the contact form, by email at contact@old-money-outfits.co.uk, or by post at 15 rue des Halles, 75001, Paris, France.

    You will receive a returns form which must be completed and included in your parcel.

    This form can also be downloaded from your customer account.

    If you do not have access to a printer, simply copy all the information from the returns form onto a piece of paper and include it in your parcel.

    Also, ensure that you include the following:

      • Your order number.
      • The names of the items being returned.
      • Your request (refund, voucher, or exchange).

    Then, send the product to the address indicated on the returns form (please note that return shipping costs are your responsibility).

    Once the item is received, it will be inspected and, based on your request, it will be exchanged or refunded.

    Please note that we reserve the right to refuse returns that have not been requested or made within the specified time limits, as well as returns of items that are not in the same condition as when they were received.

    Once your return is accepted, you will receive a confirmation email indicating that you have been refunded.

    Refunds will be processed within a maximum of 10 days and will be made using the payment method you used for the order.

    If you requested an exchange, you will also receive a confirmation email and a new tracking number.

    B. You wish to return an item that is defective.

    We do everything possible to ensure that each item is of the highest quality and arrives in excellent condition.

    Nevertheless, if there is any problem, we apologise in advance.

    In such cases, please follow these steps:

        • Fill in the contact form and attach photos of the product. These should show the entire product as well as the defects.
        • Do not clean the item, even if it has a stain or defect; regardless of the defect, please inform us before doing anything, as failure to do so may result in your return being rejected.
        • Your request will be processed within 48 hours.
        • You will have the choice between a refund, a voucher, or an exchange.

      Your satisfaction is our highest priority.

      C. Items That Cannot Be Returned

      Certain products, due to their nature, cannot be legally returned. This includes:

      • Body products if they have been opened.
      • Any other product that would pose hygiene issues if returned.

      ARTICLE 12 Bis – DELIVERY TIMES

      Below are the delivery times:

      A) For United Kingdom

      To process your order, prepare it and finally dispatch it, our lead times are as follows: we require approximately 1 to 2 days for dispatch (Monday to Friday) and 6 to 11 days for delivery (Monday to Friday), for a total delivery time of 7 to 13 days.

      Please note that we do everything possible to ensure that orders are processed as quickly as possible.

      However, these times do not account for possible strikes, delays, or other events beyond our control.

      ARTICLE 13 – WARRANTIES

      The Seller is liable for any defects in conformity of the goods with the contract and for hidden defects, under the conditions provided in Articles 1641 to 1649 of the Civil Code.

      In short, you are entitled to a 2-year guarantee and protection against hidden defects.

      ARTICLE 14 – LIABILITY

      The Seller disclaims any liability for damages resulting from improper use of the purchased product or for damages caused by use not in accordance with safety standards.

      ARTICLE 15 – PERSONAL DATA

      The Seller retains the personal data provided by the Customer in accordance with legal obligations (accounting, invoicing, etc.).

      The Customer has the right to access, modify, and delete the data concerning them.

      ARTICLE 16 – DISPUTES

      Any dispute relating to the existence, interpretation, execution, or termination of the contract concluded between the Seller and the Customer, even in the case of multiple defendants, will, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the French courts.

      However, it is also possible to resort to a mediator.

      ARTICLE 17 – LANGUAGE OF THE CONTRACT

      These General Terms and Conditions of Sale are drafted in French.

      If they are translated into one or more foreign languages, only the French text shall be authoritative in the event of a dispute.

      ARTICLE 18 – FRAUD

      In the event of attempted fraud, unauthorised payment, or any other illegal act, your information will be provided to the relevant authorities.

      ARTICLE 19 – DATA PROTECTION COMMITMENT

      We are committed to protecting your data as best we can.

      Our site is secured with HTTPS and an SSL certificate, our database and all its information are encrypted, and all software used to maintain the functionality of the site is regularly updated.
